Privacy Policy

HAPPYFORCE, S.L. (hereinafter, “HAPPYFORCE”) with C.I.F. B-66581547 and domiciled in Passeig Isabel II, núm. 12, 08003 Barcelona, duly registered in the Mercantile Registry of Barcelona in Volume 44929, Folio 205, Page 471645, Inscription 1, declares that it is the owner of the domain https://myhappyforce.com/ (hereinafter, the “Web”) and of the application “Happyforce” (hereinafter, the “App”) in accordance with the obligations foreseen in the Law 34/2002, of July 11, 2002, of services of the information society and electronic commerce (hereinafter, the “LSSI-CE”).

Under the terms of the applicable data protection regulations and, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, the “GDPR”) and Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (hereinafter, the “LOPDGDDD”), the Data Controller is:

HAPPYFORCE has adapted the Web and the App to the RGPD and the LOPDGDD. To do this, it has implemented those policies, means and technical and organizational procedures to ensure and protect the confidentiality, integrity and availability of your personal data.

3. Principles we will apply to your personal information

In processing your personal data, we will apply the following principles, which are in accordance with the requirements of the GDPR:

• Principle of lawfulness, loyalty and transparency: We will always require your consent for the processing of your personal data for one or more specific purposes that we will inform you in advance with absolute transparency.

• Data minimization principle: We will only ask you for data that is strictly necessary in relation to the purposes for which we require it.

• Principle of limitation of the storage period: The data will be kept for no longer than necessary for the purposes of the processing, depending on the purpose, we will inform you of the corresponding retention period.

• Principle of integrity and confidentiality: Your data will be treated in such a way as to ensure adequate security of personal data and to guarantee confidentiality. You should know that we take all necessary precautions to prevent unauthorized access or misuse of our Users’ data by third parties.

4. Data collection and confidentiality

The data provided to HAPPYFORCE by different means, contact forms, surveys or procedures used during the collection, will be treated in accordance with current data protection regulations, and for the sole purpose of providing the service that you have been informed.

The transmission of data by the User of HAPPYFORCE services [in particular, employees or managers of the client company] (hereinafter, the “User”) through the Website or the App, is done on a voluntary basis and they are informed prior to the processing of the use and purposes thereof.

HAPPYFORCE informs the User that only the information necessary to achieve the purpose of the processing is collected and only the data provided will be processed for the purpose/s for which they were informed and subsequently authorized.

HAPPYFORCE, in its capacity as Data Controller, guarantees confidentiality in the processing of all personal data of the User to which it has access. The Data Controller, like any other person involved in any phase of the processing, is subject to the strictest professional secrecy, with a special commitment to adopt the necessary levels of protection and measures, both technical and organizational, to ensure the security of personal data and prevent its alteration, misuse, loss, theft, treatment or unauthorized access.

All information provided by the User to HAPPYFORCE must be truthful, and the User will be solely responsible for any false or inaccurate statements made and for any damages caused to HAPPYFORCE or third parties.

HAPPYFORCE reserves the right to exclude from the services to any User who has provided false information, without prejudice to other legal actions that may apply.

5. Personal data

They refer to any information or data that can identify you directly (e.g., your name or surname) or indirectly (e.g., your national identity card or D.N.I.).

Personal data includes information such as e-mail address, date of birth, professional category, gender, salary range, employer/company and professional information, job titles, user-generated content, as well as any other information generated by HAPPYFORCE in the performance of the services provided by HAPPYFORCE to the User in the course of its business.

It may also include unique numeric identifiers such as the IP address of your computer or the MAC address of your mobile device, as well as information we obtain through cookies.

6. Data processing and purposes of processing

HAPPYFORCE will process the following User data, manually and/or automatically, for the following specific purposes:

The legitimization by HAPPYFORCE to carry out the processing of personal data for the contracting of services is the contractual relationship itself; in the case of data provided for the request of a demo or a contact form is the consent of the person concerned requested for the particular case. The legitimacy for the interaction of users for the operation of products and services of HAPPYFORCE is the consent of the person concerned by accepting the corresponding privacy policy. For the sending of commercial communications and newsletters to HAPPYFORCE customers, legitimate interest may be used, and consent is required to carry out such treatment with users who are not HAPPYFORCE customers.

In order to carry out the above-mentioned purposes, we may rely on automated decisions, including the preparation of recommendation reports for our customers. In any case, we will only use the data necessary for the elaboration of the profile, which will be previously encrypted as a security measure. 

7. Data processing by third parties and transfer

Depending on the purposes for which personal data is collected, such information may be accessed, without distinction, by the following persons:

• Authorized personnel of HAPPYFORCE or its representatives acting on its behalf, subject to the applicable data protection regulations in force.

• Regulatory authorities or other third parties in accordance with applicable laws.

• Third parties [IT service providers that process information, host servers, maintain databases, software and application support]. This is only after we have taken the necessary steps to ensure that we can share such information in compliance with data protection regulations.

HAPPYFORCE will not disclose to third parties any personal information or data that you have provided on the Website or the App and that can identify you directly or indirectly, except by legal mandate.

If there is a sale, merger, consolidation, change in corporate control, substantial asset transfer, reorganization or liquidation of HAPPYFORCE, then, at our discretion, we may transfer, sell or assign the information collected on the Website or App to one or more other relevant parties, subject to prior legal agreement to the contrary.

8. Data Retention

Personal data will be kept for the time strictly necessary until the end of the purpose for which they were collected, and as long as the reason that justified the processing of such personal data is maintained. At the end of the reason for which the data were processed, the personal data will be duly blocked for the appropriate period of time in order to comply with the legal statute of limitations in order to prevent possible infringements.

9. Direct Marketing

HAPPYFORCE does not use your personal data for direct marketing purposes without your express prior consent.

If at any time you decide to stop receiving commercial information from HAPPYFORCE you may, free of charge and without having to provide a justification, unsubscribe from direct marketing campaigns and object to the future processing of your personal data for such purposes by sending an email to gdpr@myhappyforce.com.

Please note that, even if you choose not to subscribe or unsubscribe from commercial, promotional or newsletter emails, we may still need to contact you regarding important non-commercial information, as well as any communication that is necessary to comply with our legal obligations.

10. Security measures

HAPPYFORCE adopts the security levels required by the RGPD appropriate to the nature of the data that are processed at all times by its activity.

In this regard, HAPPYFORCE has implemented appropriate technical and organizational measures designed to ensure a level of security appropriate to the risk, including as appropriate: (a) pseudonymization (such as where data is separated from direct identifiers so that it cannot be linked to an identity without additional information being held separately) and encryption, (b) protecting the continued confidentiality, integrity, availability and resilience of the systems and services used to process your personal information, (c) providing the ability to restore availability and access to personal information in a timely manner in the event of a physical or technical incident; and (d) maintaining a process for regularly testing and evaluating the effectiveness of technical and organizational security measures. When you submit information to us through our website, your information is protected both online and offline. All data transferred to/from the HAPPYFORCE internal network, to/from an external entity, is encrypted according to industry standards. Please note that messages you send to us via Internet e-mail may not be secure. We maintain appropriate physical, electronic and procedural safeguards to ensure the security, integrity and privacy of your personal information within our company. Only those employees who may require your information to perform a specific job are granted access to your organization’s personally identifiable information. In addition, all employees are kept up-to-date on our security and privacy practices.

It may also use secure techniques to anonymize the personal data [anonymization of non-personal data] that it processes in order to carry out its business. 

However, technical security in a medium such as the Internet is not impregnable and there may be malicious actions by third parties, although HAPPYFORCE applies the means at its disposal to prevent such actions.

11. Rights of the interested parties and their exercise

In accordance with the RGPD and the LOPDGDG, Users may exercise the following rights:

• Right of access: The User may ask HAPPYFORCE if it is processing their data and, if so, access them.

• Right of rectification: The User may request rectification of the data if they are inaccurate, or complete the data that we have incomplete.

• Right to request the deletion of your data.

• Right to request the limitation of their treatment: In this case we will only keep them for the exercise or defense of claims.

• Right to object to the processing: HAPPYFORCE will stop processing personal data, with the exception that they should continue to be processed for legitimate reasons or for the exercise or defense of possible claims.

• Right to data portability: In the event that the User wants his/her data to be processed by another data controller, HAPPYFORCE will facilitate the transfer of his/her data to the new data controller.

• The right not to be subject to a decision based solely on the automated processing of your personal data.

If the User has given consent for any specific purpose, he/she may withdraw it whenever he/she wishes, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.

In any case, at the time the User exercises his or her right of deletion, all personal data linked to his or her account, as well as the information and content included in his or her profile, will be deleted. Likewise, in the event that the User exercises the right of deletion of the data necessary for HAPPYFORCE to provide the services of the Website, HAPPYFORCE will be obliged to terminate its relationship with the User, proceeding to unsubscribe the User, without the right to any claim whatsoever on the part of the User.

To exercise your rights, including to make a complaint in case you consider that HAPPYFORCE is treating your data inappropriately, you must send a written communication to the registered office of HAPPYFORCE or to the e-mail address gdpr@myhappyforce.com, including in both cases a photocopy of your National Identity Card, National Identity Card or other equivalent identification document.

You can use the models and forms on the rights referred to above by going to the official website of the Spanish Data Protection Agency (https://www.aepd.es/). If you consider that HAPPYFORCE is treating your personal data inappropriately, you can address your complaints to this Control Authority.

12. International data transfers

We also transfer the personal information we process to countries outside the European Economic Area (“EEA”) (for example, where one of our service or equipment providers is located outside the EEA, such as to host your personal information). We have implemented appropriate safeguards with respect to the protection of your privacy, fundamental rights and freedoms, and the exercise of your rights, for example, we establish an adequate level of data protection, generally through EU Standard Contractual Clauses based on the EU Commission’s model clauses.

13. Changes in the privacy policy

We will only use personal data as set forth in the Privacy Policy in effect at the time such data is collected.

HAPPYFORCE reserves the right to modify at any time this Privacy Policy, publishing such changes on the Web, so it is recommended to visit it each time you access it. If at any time we decide to use personal data differently from what was stated at the time it was obtained, the User will be informed by email, provided that we have the same. At that time, you will be given the option to authorize other uses or disclosures of the personal data that you had provided to us prior to the modification of our Privacy Policy.

In the event that any clause of this Privacy Policy is annulled or considered null and void, the rest of the conditions shall not be affected, and shall remain fully valid and in force, in accordance with the applicable regulations in force at any given time.

Our website uses or may use hyperlinks that allow a link to other pages or websites. HAPPYFORCE is not responsible for the content of such websites nor are they responsible for the privacy policies of such websites. You should be aware of and read the privacy policies of all websites you visit. Remember that what is indicated in this Privacy Policy only applies to the data collected and/or processed by HAPPYFORCE.

HAPPYFORCE is present in social networks and, in addition to these, provides Users with the possibility of communicating through various means of social communication. The processing of data of people who become followers, establish a link or relate to HAPPYFORCE through social networks or media made available to them, shall be governed by the legal notice of our website and the terms of use, privacy policies and other regulations of access, use and the like of the social network or medium concerned. The User is aware of them and will have previously accepted them.

15. Applicable Legislation

The privacy of all information provided, both that provided by the User through the various forms for requesting personal data, as well as that accessible through the Web and / or the App, is regulated by the data protection regulations in force, in particular, by the RGPD and the LOPDGDD.
